Electronic Transmittal (ET) No. 08-05, Approval of Justification For Other Than Full And Open Competition

  1. Purpose: This memorandum is issued to incorporate changes to the Reclamation Acquisition Regulation (RAR). The RAR changes are described in paragraph 4 below.
  2. Effective Date: This guidance is effective immediately upon issuance.
  3. Expiration Date: Until cancelled, revised, or superseded.
  4. Background:
    1. The approval level required for a justification for other than full and open competition as prescribed in WBR 1406.304(a) and 1413.501(a)(2) are hereby changed. CCO approval is now required of justifications greater than $25,000 and up to $550,000; also, the CCO may require their approval of a justification at a lower amount. Previously the contracting officer could approve justifications up to $550,000.
    2. The provision at WBR 1406.304(a), Approval of the justification, is hereby changed to:

      WBR 1406.304 Approval of the justification.

      (a) Justification for other than full and open competition for proposed transactions which are expected to:

      (i) exceed $25,000 (or at a lower amount if so specified by the CCO), but not exceed $550,000, shall be approved by the CCO;
      (ii) exceed $550,000 but not exceed $11,500,000 shall be signed by the CO and the CCO and submitted to AAMD, 84-27800, for approval by the Reclamation competition advocate;
      (iii) exceed $11,500,000 but not exceed $57,000,000 shall be processed through the Reclamation competition advocate for approval by the HCA and shall contain the title, signature, and date of approval of each official.

    3. The provision at WBR 1413.501(a)(2), Special Documentation Requirements, is hereby changed to:

      WBR 1413.501 Special Documentation Requirements.

      (a)(2) Justifications for sole source actions must be approved:

      (i) Over $25,000 (or at a lower amount if so specified by the CCO), but not exceeding $550,000, shall be approved by the CCO;
      (ii) Over $550,000 but not exceeding $11,500,000 shall be signed by the CO and the CCO and submitted to AAMD, 84-27800, for approval by the Reclamation competition advocate.
      (iii) Over $11,500,000 but not exceeding $57,000,000 shall be processed through the Reclamation competition advocate for approval by the HCA and shall contain the title, signature, and date of approval of each official.

  5. Action Required: Distribute this ET to all acquisition personnel and ensure that the revised approval provisions at WBR 1406.304(a) and 1413.501(a)(2) are adhered to. The RAR will be revised as a result of this ET at a later date.
