Reclamation Acquisition Regulation (RAR) System Update

Expires: November 16, 2007, or, upon enactment of the FY 2008 Energy and Water Development Appropriations Act, if signed sooner. Should the CR be extended or a new CR enacted, this guidance will be updated by an ET supplement.

Electronic Transmittal (ET) No. 08-03, Reclamation Acquisition Regulation (RAR) System Update

                                     
  1. Purpose: To transmit revisions to the RAR.
  2. Effective Date: This guidance is effective immediately.
  3. Expiration Date: Until cancelled or superseded.
  4. Background:
    1. The RAR was last updated by release of Electronic Transmittal (ET) 05-09 dated September 14, 2005. At that time the RAR was updated to Federal Acquisition Circular (FAC) 2001-27, Department of the Interior (DIAPR) 2005-03, and ET 05-09.
    2. With release of this ET the RAR is updated to incorporate updates as described in paragraph 5 below.
    3. The RAR can be found at the following website:

  5. Explanation of Changes:
    1. FAC (Update to incorporate FAC 2005-01 to 2005-20)
      1. FAC that affect changes to the RAR -
        1. FAC 2005-07 – replace reference to “PBSA” with “PBA” throughout the RAR
        2. FAC 2005-08 –
          1. replaced the Trade Agreement threshold table in WBR 1425.402(b) and 1452.225-82 with a reference to the table contained in FAR 25.402(b).
          2. Corrected titles of various Buy American Act and Trade Agreement FAR clauses referenced in WBR 1425.1101 and 1452.225-80.
        3. FAC 2005-13 – revised approval thresholds for other than full and open competition in WBR 1406.304 and 1413.501.
    2. DIAPR (Update to incorporate DIAPR 05-04 to 07-07)
      1. DIAPR that affect changes to the RAR -
        1. 06-09 - revised WBR to reflect changes to replace the COWS with the new FAC-C & COA Programs; revised WBR 1401.603 and 1439.8001.
    3. ET (Update to incorporate ET 05-10 to 08-02)
      1. ET that affect changes to the RAR -
        1. 06-04 (Supp.1) –
          1. revised and replaced clause WBR 1401.7001-3(b)(2)(iii)(G); AAMD review and waiver of non-PBA actions.
          2. Added RAR subpart 1437.6, Performance Based Acquisition
        2. 06-04 (Supp.2) –
          1. delete WBR 1433.103(a), 1433.106, and 1452.233-80 to remove the terms for agency protests to the BPC.
          2. Previous clauses WBR 1433.103(b), (c), and (d) are renumbered 1433.103(a), (b), and (c), respectively.
        3. 06-13 – delete WBR 1419.202-70(d) which removes the requirement to use of the DI-1886 in certain simplified acquisition situations.
        4. 06-15 – delete 1423.302-84(a)(3) for the acquisition of Video Display Terminal (VDT) eyeglasses.
        5. 07-01 –
          1. revised and replaced WBR 1437.81 and 1452.237-80, Security Requirements
          2. Changed WBR 1437.81 title from “Information Technology/Compulsory Protection of Sensitive Information and Security Access Requirements” to “Security Requirements”
        6. 07-05 – revise WBR 1417.80 to replace 1417.8001 & 1417.8002 and delete 1417.8003 to incorporate RAR and PURLBOOK non-monetary awards of entertainment changes.
        7. 07-09 – replace and revise WBR 1413.301 to reflect changes from release of revised PURLBOOK (July 2007).
    4. Other
      1. RAR parts are combined into a single Word document
      2. Table of contents inserted at the beginning of the RAR
      3. Links inserted throughout the RAR
        1. Links within the RAR to WBR Parts, Subparts and clause references
        2. Links to external references (e.g. DIAR, DIAPR, DM, RM, USC., CFR)
      4. Forms reinserted in Word and Adobe formats so entire form is again found
      5. Update Denver and Washington Office mail codes referenced throughout to reflect current codes (i.e. D-7800 replaced by 84-27800)
      6. Update to incorporate new Department COR Program released 10/10/2006. Revised WBR 1401.670-2 to replace references to the DIAR with reference to the Department COR Program Manual.
      7. Correct title of WBR 1412 from “Simplified Acquisition Procedures” to “Acquisition of Commercial Items” to correspond with the content and the FAR.
      8. Correct WBR clause numbered 1415.501 to 1413.501.
      9. Correct part numbering of WBR 1406, Forms, to 1453, Forms, to correspond with content and the FAR.
  6. Action Required:
    1. Implement updates incorporated into the updated RAR.
    2. Distribute this ET to all acquisition and other affected personnel.
