Enclosed is Modification No. ____ , issued on a unilateral basis under the authority of the contract clause entitled [e.g., Availability of Funds]. An explanation of the modification is provided below for your information.
Funds have previously been allotted in the amount of [enter the total amount of funds allotted to date to cover payment]. The Energy and Water Development Appropriations Act (Act) for fiscal year 2007 has not been passed at this time. This Act provides Bureau of Reclamation (Reclamation) funding, in general, and funding for your contract, specifically.
Prior to the effective date of appropriation acts, it has been the custom of Congress to provide interim appropriations under a continuing resolution. The Congress has passed such a resolution providing appropriations for the period October 1, 2006 through November 17, 2006, unless the Act is passed prior to the latter date. Under this continuing resolution and any extension thereof by Congress, funds are made available and are reserved under the enclosed modification for the above-referenced contract at the rate provided for in the resolution.
The funds allotted are provided to cover all payments under the contract schedule items, and all other earnings (including retained earnings) that may be due under the contract for the period of the continuing resolution, (including any extension authorized by Congress) or until the Act is passed.
It is expressly understood, however, that the Government has no obligation to provide funds in addition to those reserved in writing, either previously or pursuant to the joint resolution and any extension thereof. Therefore, you are cautioned that the prosecution of contract work at a rate in excess of the rate provided for in the continuing resolution will be at you own risk.
