Subject: Electronic Transmittal (ET) No. . 06-04, Supplement 1, Reclamation Acquisition Regulation (RAR) Revision Project

1. Purpose: To transmit revisions to the RAR.

2. Effective date: Upon date of issue.

3. Expiration date: In effect until revised.

4. Background: This memorandum (and its supplements) is used to issue final acquisition regulation revisions during fiscal year 2006. The attached RAR changes are described in paragraph 5 below.

5. Explanation of changes:

1) WBR 1401.7001-3(b)(2)(ii)(G) is revised to clarify the current policy.

Change to:

(G) Statements of Work for services expected to equal or exceed $100,000 that are not in the format prescribed in FAR 37.601, generally known as Performance-Based Service Acquisition (PBSA), are required to be submitted to D-7800 for review and approval. The submission shall include a detailed justification for not utilizing the PBSA format; or

Change from:

(G) Solicitations for services equal to or greater than $100,000. A detailed justification for not utilizing the Performance-Based Service Contract (PBS) format (meeting the standards set forth in FAR 37.601) for any proposed requirement for services expected to exceed $100,000 is required to be submitted to D-7800 for review and approval, or

2) WBR 1437 is revised to add Subpart 1437.6, Performance-Based Contracting, which will include information regarding the preparation of a Determination and Findings for Not Using Performance-Based Contracting to be signed by the CCO for all actions equal to or greater than $25,000 but less than $100,000.

6. Action required:
