Department of the Interior Acquisition Policy Release (DIAPR) 2004-03

SUBJECT: Departmental Class Determination and Findings for Inter-Intra Agency Acquisitions Subject to the Economy Act When the Servicing Agency is Not Subject to the FAR and Will Provide Services or Goods Directly to the Department of the Interior Requesting Agency

1. Purpose:

This policy release transmits a copy of the subject Class Determination and Findings document. This DIAPR will only be transmitted electronically, except by facsimile to BIA; accordingly a copy should be printed and filed locally with copies of the Department of the Interior Acquisition Regulation. The DIAPR will also be posted on the Office of Acquisition and Property Management's website (http://www.doi.gov/pam), under the "Acquisition" section.

2. Effective Date:

The attached Determination and Findings is effective upon issuance.

3. Expiration Date:

The attached Determinations and Findings is effective through September 30, 2006, unless it is rescinded or superseded prior to that date.

4. Background and Explanation:

At the request of the Bureau of Reclamation, which does business with the Bonneville Power Administration and other agencies that are exempt from the Federal Acquisition Regulation (FAR), the attached Class Determination and Findings relative to the approval process required for certain Economy Act Determinations in FAR 17.503(c) was generated. Given that other bureaus and offices may find themselves in the same situation it was decided to provide a Class Determination to all bureaus and offices via a DIAPR.

5. Action Required:

Bureau Procurement Chiefs shall ensure that the attached document is widely disseminated within their acquisition community and that the authority provided in the document is used appropriately in their bureaus and offices. Note that this Class Determination does not apply to situations where the FAR exempt agency is going to provide acquisition services for the requesting DOI bureau or office.
