Subject:  Electronic Transmittal (ET) No. . 05-07– DIAPR 2004-03 -Departmental Class Determination for Inter-Intra Agency Acquisitions Subject to the Economy Act When the Servicing Agency is Not Subject to the FAR and Will Provide Services or Goods Directly to Reclamation

1. Purpose: To transmit Department of the Interior, Office of Acquisition and Property Management DIAPR 2004-03 and Senior Procurement Executive Memorandum, dated February 4, 2004.

2. Effective Date: February 4, 2004.

3. Expiration Date: This ET remains in effect through September 30, 2006, unless it is rescinded or suspended prior to that date.

4. Background: The Pacific Northwest (PN) Regional acquisitions office awards a number of interagency acquisitions (IA’s) to the Bonneville Power Administration (BPA). The BPA is exempt from the Federal Acquisition Regulation (FAR). The FAR 17.503 requires the Senior Procurement Executive to approve all IA’s with agencies exempt from the FAR. The PN regional acquisitions office requested D-7800 to propose a deviation from the FAR when those agencies exempt from the FAR were not providing the goods/services through contracting out the requirement but were performing the requirement in-house. As most of the IA’s issued to the BPA are performed in-house, this deviation would eliminate much of the time required to award the IA’s by not requiring higher level approval.

6. Action Required: Regional acquisition offices should distribute this memorandum to all acquisition personnel.
