Subject: Electronic Transmittal (ET) No. 05-05 – Class Deviation
1. Purpose: To provide a class deviation to RAR Subpart 1437.81 – Security Requirements.
2. Effective Date: This ET is effective October 28, 2004.
3. Expiration Date: This ET remains in effect, as may be amended, until cancelled or superseded by incorporation of the following changes into the RAR.
4. Background: WBR 1401.480(a) provides that the Bureau Procurement Chief is authorized to approve any deviations from the RAR. WBR 1437.8102(c) provides that the Contractor shall conduct a background investigation of each individual employee prior to that individual performing work.
5. Explanation of Changes:
a. Low risk contracts may be considered to be exempt from the foregoing background investigation requirement.
b. Paragraph (a)(3) of the clause at RAR WBR 1452.237-80, Security Requirements, Information Technology /Compulsory Protection of Sensitive Information and Security Access Requirements – Bureau of Reclamation (JUL 2004), may be appropriately modified to reflect this exemption.
6. Action Required:
a. Regional acquisition offices shall distribute this ET to all acquisition personnel.
b. Requisitioners shall continue to coordinate all requirements for services (including construction) to be acquired under the procedures of FAR Parts 8, 12, 13, 14, 15, 35, or 36 with the Reclamation Security Officer (D-1450) or appropriate regional Security Officer, and, for IT requirements, the Bureau IT Security Manager (D-1450), to identify the appropriate risk sensitivity level.
c. Contracting Officers shall continue to insert the clause
at WBR 1452.237-80, Security Requirements, Information Technology/Compulsory
Protection of Sensitive Information and Security Access Requirements
– Bureau of Reclamation (JUL 2004), in all solicitations, contracts,
purchase orders, orders under Federal Supply Schedules, and task orders
issued under Government-wide Agency Contracts (GWACs) and Multi-Agency
Contracts (MACs) for service (including construction) requirements in
accordance with the prescriptive instructions at WBR 1437.8103, Contract
Clause.
