The attached General Services Administration's Civilian Agency Acquisition Council (CAAC) Letter 2004-04 dated December 27, 2004, explains that FAR Subpart 19.11, authorizing civilian agencies to apply the price evaluation adjustment in competitive acquisitions for small disadvantaged business concerns listed under certain authorized NAICS industry subsectors, is no longer in effect. The requirement, first authorized under the Federal Acquisition Streamlining Act of 1994, expired December 9, 2004. The law was continued under the SBA's temporary authorizations but was omitted from the Small Business Reauthorization and Manufacturing Assistance Act of 2004(P.L. 108-447).
The statutory government-wide goal for contracting with SDB's set at not less than 5 percent is still in effect.
The effective date of this release is December 9, 2004. Please circulate the policy issuance as widely as possible.
