Subject: Business Utilization and Development Memorandum (BUDM) 03-03, - Removal of Large Businesses from PRO-Net
The purpose of this BUDM is to transmit Memorandum, Associate Deputy Administrator For Government Contracting and Business Development, Small Business Administration, May 9, 2003, subject as above.
Your specific attention is called to the second to last paragraph of this memorandum. SBA is requesting that contracting officers be proactive when reviewing offers' small business self-certifications. FAR 19.301(b) provides that the contracting officer shall accept an offeror's representation in a specific bid or proposal that it is a small business unless (1) another offeror or interested party challenges the concern's small business representation or (2) the contracting officer has a reason to question the representation. SBA suggests that contracting officers use PRO-Net employment and revenue data to assess an offeror's self-certification by comparing it to the size standard of the procurement and that COs use this data in conjunction with their other knowledge about a business to make an informed decision.
